KAVACH Terms & Conditions (For India Consumers)

1. Agreement to Terms

By downloading, accessing, or using the Kavach app or Services, you agree to these Terms & Conditions (“Terms”). If you do not agree, do not use the Services.

2. Eligibility

You must be legally capable of entering into a contract under Indian law. If you are under 18, you may use the Services only with verified parental/guardian consent and supervision (as applicable).

3. Description of the Services

Kavach provides personal safety features including (depending on your configuration):

• SOS triggers and alerts
• Location sharing with emergency contacts
• Safety check-ins / escalation
• Optional device accessory pairing

Important: Kavach is an assistive tool. It does not guarantee prevention of harm, emergency response times, network availability, or successful delivery of SMS/calls/notifications.

4. Not an emergency services replacement

In an emergency, you should contact official emergency services. India’s pan-India emergency number is 112 (availability and handling may vary by state/UT).

5. Your responsibilities

You agree to:

• Provide accurate information and keep your emergency contacts updated
• Obtain consent from people you add as emergency contacts (they may receive alerts/communications)
• Use the Services lawfully and not for harassment, stalking, or false alarms
• Keep your device secure (PIN/biometrics), and maintain connectivity and battery where possible

6. Permissions

Certain features require device permissions (location, notifications, contacts, microphone, Bluetooth). You can manage permissions in device settings, but disabling them may prevent features from working.

7. Prohibited use

You must not:

• Use Kavach to send false distress signals, spam, or harass others
• Reverse engineer or attempt to extract source code (except as allowed by law)
• Interfere with the Services, overload systems, or bypass security
• Use the app in violation of any applicable law

8. Fees, subscriptions, and third-party charges

Kavach may offer free and paid features. If you purchase a subscription/in-app purchase, billing is handled by the relevant app store and subject to its terms.

Telecom charges: SMS/calls may incur charges by your operator. Kavach is not responsible for carrier fees.

9. Intellectual property

All rights in the app, trademarks, logos, UI, and software are owned by Kavach or its licensors (including MyoTrack Inc.). You receive a limited, revocable, non-exclusive license to use the app for personal, lawful purposes.

10. User content (if applicable)

If the Services allow you to submit content (e.g., support messages, feedback), you grant us a license to use it to operate and improve the Services. Do not submit illegal or infringing content.

11. Privacy

Our Privacy Policy explains how we collect and use data and is incorporated into these Terms by reference.

12. Service availability and changes

We may modify, suspend, or discontinue parts of the Services at any time. We may also update these Terms and will post changes with a new “Last Updated” date.

13. Disclaimer of warranties

To the maximum extent permitted by law, the Services are provided “as is” and “as available”. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of liability

To the maximum extent permitted by law:

• Kavach will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits/data, arising from use of the Services.
• Kavach is not liable for failures due to telecom/network outages, GPS inaccuracies, device limitations, third-party service failures, or user configuration errors.

Total liability, if any, will be limited to the amount you paid to Kavach in the last 6 months for the Services, or INR 10,000, whichever is lower.

15. Indemnity

You agree to indemnify and hold Kavach harmless from claims arising from your misuse of the Services, violation of these Terms, or violation of applicable law.

16. Termination

We may suspend/terminate your access if you violate these Terms or if required by law. You may stop using the Services at any time.

17. Governing law and dispute resolution

These Terms are governed by the laws of India.

Dispute resolution (Arbitration):
Disputes will be resolved by arbitration under the Arbitration and Conciliation Act, 1996.
